Best conditions extended to foreign labor permits in Binh Duong

Direct dialogue with over 200 representatives of Chinese businesses revolves around licensing for foreign experts, engineers, managers, and workers living and working in Binh Duong. The leaders of the Department of Labor, Invalids and Social Affairs (DOLISA) stated that the department and local authorities always provide full support for licensing activities to be carried out in the correct order and as quickly as possible.

On the morning of September 30, at the Vocational College of Binh Duong Vocational Business, a direct dialogue between the leaders of the Department of Labor, Invalids and Social Affairs and over 200 representatives of Chinese businesses revolved around the issue of licensing for management. Many obstacles were resolved by foreign experts, engineers, and workers. Dozens of direct questions raised by business representatives were satisfactorily answered by the department's technical staff.

In addition to the licensing procedures, many issues regarding the recruitment and job transition of foreign workers are also mentioned by businesses.

Mrs. Nguyen Thi Nhu Quynh, Deputy Head of Labor and Social Affairs Department, Department of Labor, Invalids and Social Affairs, said that the dialogue aims to exchange and provide guidance on the implementation of Government Decree No. 70/2023/ND-CP of 2023 amending and supplementing some articles of Government Decree No. 152/2020/ND-CP of 2020 on foreign workers working in Vietnam and the recruitment and management of Vietnamese workers working for foreign organizations and individuals in Vietnam. “Although there are specific guidelines, many business representatives do not thoroughly study the procedure documents according to regulations during the licensing process, resulting in prolonged licensing time,” Mrs. Quynh said.

According to Mrs. Nguyen Thi Nhu Quynh, Decree 70/2023/ND-CP has many new points, removing many difficulties and creating more favorable conditions for foreign workers in licensing. Specifically, according to Decree 152/2020/ND-CP, when foreign workers apply for a work permit, they need to prove their work experience in the field they are currently working in. However, Decree 70/2023/ND-CP provides more favorable conditions, allowing foreign workers to reuse the work experience permit that has been granted to them for their application.

Decree 70/2023/ND-CP has many new points, creating more favorable conditions for businesses in granting work permits to foreigners, but alongside that, it also tightens the management in granting permits.

Mr. Pham Van Tuyen, Deputy Director of the Department of Labor, Invalids and Social Affairs, said that one of the important changes in Decree 70/2023/ND-CP that businesses are most interested in is that previously, businesses requested labor permits for general job positions without specific job titles. For example, employees, technicians, and managers. This makes it difficult to check, review and resolve the explanations of the demand for using foreign labor when businesses submit to the department the contents of job positions and job titles. Therefore, currently, when explaining the demand for using foreign labor, businesses must specify the job position with a specific title, associated with the actual job being performed.

“During the process of applying for a work permit, businesses must clearly determine the needs, positions, and job titles of foreign workers. The required documents for the licensing procedure must still be valid according to the law, such as health certificates, diplomas, professional licenses. To ensure that labor contracts at the enterprise are valid when compared, and to avoid the situation of having to travel multiple times to resolve administrative procedures, wasting the time of the enterprise," Mr. Pham Van Tuyen, Deputy Director of DOLISA, noted.
