Drastic direction

According to the land use plan by 2020, Binh Duong has been approved by the Government with 209 works and projects in the period with an additional area of ​​12,460 ha. So far, the province has carried out 188 projects and projects, corresponding to a total area of ​​9,850 hectares. In addition, following the provisions of the Land Law 2013, the province has approved the issuance of Decision No. 49/2015 / QD-UBND dated November 2, 2015 and Decision No. 24/2017 / QD-UBND dated 25th -9-2017, direct the organization of training and implementation of contents to People's Committees of districts, towns, cities and investors in project management to ensure the implementation of the registered schedule and report progress of investment project implementation after having decided to allocate, rent or transfer land use purposes.

In addition, the province has asked the district and commune People's Committees to review cases of land violations to report to the Provincial People's Committee. The province also requested People's Committees of communes, wards and townships in the province to notify enterprises operating in the locality to report on the implementation of regular projects. On that basis, the province has reviewed and put projects on land allocation, land lease and land use purpose change after a 24-month period into the annual bar and inspection plans to promptly detect urging investors to implement the project on schedule, avoiding wasting land resources in urban areas in the province. When detecting slow progress projects, the province also directed the processing as soon as possible.

For projects included in the planning but not feasible, the province directs the review and adjustment to remove the land use planning adjustment period to 2020 of the province and has been approved by the Government in the Resolution No. 59 May 17, 2018. As for projects already included in the annual land use plans at the district level but not implemented, the province has also directed to review the time limit for implementing the project to remove them. from the plan in case the project is more than 3 years old but not yet implemented in accordance with Article 49, Land Law 2013.

In addition, for projects which have been assigned or leased land but not used for a continuous period of 12 months or the land use tempo is 24 months behind the schedule stated in the investment project from the time of handing over. In the field, the land must be put to use, the province considered to extend the time for 24 months. After this time, if the enterprise has not yet put the land into use, the province will resolutely withdraw it according to regulations.

Handling promptly

For the implementation of rights and obligations of land users in Binh Duong urban area, there have been new features recently. Implementing the provisions of the Land Law 2013, the province has had strict management, rectifying errors and violations in the process of exercising the rights and obligations of land users, ensuring the provisions of this law.

In addition, the province has issued specific regulations and policies on land to manage and supervise users in the process of exercising their rights and obligations. People's Committees at all levels in the province have recently discovered, prevented and promptly dealt with violations of the laws on land management and use in the locality. At the same time, the province also reviewed and put projects in slow implementation to the annual bar and inspection plans to promptly urge investors to implement the project on schedule, avoid wasting resources. local land.
