Verification and approval processes of constructions and projects boosted

In order to speed up the implementation progress and to early deploy investment projects, one of the solutions to remove drawbacks and obstacles is to accelerate right from the appraisal and approval processes.

In 2022, the total investment capital plan of the Binh Duong provincial Traffic Construction Investment Project Management Board is more than VND 1,961 billion. However, as of September 30, the volume of capital payment was only VND 466.5 billion or 23.78% of the plan. The volume of capital payment acceptance was VND 406.5 billion or 20.72% of the plan. The value of advance payment and due payment was VND 354.3 billion or 18.06% of the plan.

Explaining the low payments, Vo Ngoc Sang - Deputy Director of the provincial Traffic Construction Investment Project Management Board, said that the construction faced problems that some items to relocate the power grid are currently pending for the Department of Industry and Trade to be able to review and report to the provincial People's Committee on determining the source of relocation capital to serve as a basis for project appraisal and approval. Some projects are in the investment preparation stages after the feasibility study report has been completed and the appraisal has been completed by the specialized management departments; however, because the medium-term capital plan has not been yet arranged or balanced to complete the project in 2021-2025; therefore, it is not eligible for project approval.

Vo Ngoc Sang added: “Failure to approve will not be eligible for acceptance, payment and settlement for bidding packages for making feasibility study reports for projects. However, these bidding packages are organized for bidding to select contractors and the failure to approve the project is not the fault of the contractor, so payment must be made to the unit according to the signed contract.”

According to Sang, the work of site clearance, notice of land acquisition, investigation, survey, measurement and inventory, formulation, appraisal and approval of the extended compensation plan, the setting up and appraising land prices for compensation currently face many challenges. There are cases where the land price appraisal certificate has to be adjusted and supplemented for many times in a long time. For the works in progress of compensation, some specific problems such as disagreement on the compensation unit price or the proposal for compensation for additional structural support persisted. The settlement is still lengthy, leading to delayed handing over the site for construction, affecting the overall progress of the project. For example, regarding the DT742 - DT747a intersection roundabout construction, the site clearance has handed over since March 2019; however, 4 households have not yet handed over their sites. In addition, other problems such as the lack of available land fund for resettlement before deciding on land recovery according to regulations, the insufficient and nonpractical unit price of compensation for assets on the land, no general guidance on determining the effect of structure and use on the remaining area of ​​the house after clearance remain.

According to research, the site clearance landmark of the project of upgrading and expanding Binh Chuan - Tan Phuoc Khanh road has handed over since August 2020. However, up to now, the land acquisition dossier has not yet completed, and the land price certificate has not been submitted for approval. DT746 road work from Tan Thanh to Hoi Nghia junction was handed over from October 2021; so far, the measurement and counting has not been completed, and the draft land price deed has been incomplete.

The submission of land price certificates for Bach Dang 2 road and bridge project – a key project of the province, started in April 2021 to have undergone 5 additional adjustments which were latest on August 22, 2022 when the People's Committee of Tan Uyen town made 2 reports on the review of the land pricing plan (for the 5th time) at the request of the provincial Department of Natural Resources and Environment who has submitted to the Department of Finance - the standing agency of the provincial Land Price Appraisal Council, for appraisal according to regulations. On August 25, 2022, the Department of Finance continued to send an official dispatch to return these 2 land price certificates to the Department of Natural Resources and Environment, citing the reason why the Ministry of Finance issued Decision No. 1102/QD-BTC dated June 10, 2022 to revoke the certificate of eligibility for business in valuation services for the land price certificate construction consulting unit, which is Generation Valuation and Construction Investment Consulting Joint Stock Company.

In order to resolve the above problems, Vo Ngoc Sang said: "The Board has proposed to the departments and agencies to consider and solve the problems at the soonest to help remove obstacles in the process of carrying out the site clearance of land fund development centers. Specifically, speeding up the appraisal and submission of land compensation unit prices for approval, and advising the provincial People's Committee to adjust the regulations on compensation unit prices for properties on land are insufficient and not suitable for reality.
